Public Service Labour Relations Act May 9th, 2016

Mr. Speaker, the minister's mandate letter was very clear: all forms of harassment in the workplace are unacceptable, and the minister has a duty to take action to resolve the issue.

I have personally spoken with members who work for the association and victims of this kind of dispute, and having been a member of that very fine institution myself, I can assure the House that everyone has the utmost admiration for that institution.

I have complete confidence in that institution, and we issued a very clear request to the commissioner, asking him to conduct thorough investigations to resolve the outstanding disputes.

Furthermore, a system has been in place since 2014, and it should give us the results we are hoping for. We strongly recommend that the RCMP demonstrate that is it implementing its system in order to show how effectively it is managing this kind of crisis.

Public Service Labour Relations Act May 9th, 2016

Mr. Speaker, I am proud to rise in the House today to speak to the debate on a bill that has an impact on Canada's national police force, the Royal Canadian Mounted Police, a police force that has been the pride of Canada for nearly 100 years.

As we look back throughout Canada's history, the RCMP contributed in many ways: from the march west from Fort Dufferin in Manitoba, to the last spike of the Canadian Pacific Railway in Craigellachie, British Columbia, back when the organization was known as the North-West Mounted Police, to the St. Roch's passage through the Northwest Passage, to the vital roles it played in World Wars I and II. The RCMP's history is indeed Canadian history.

The bill before us is another important step in that history because we are seeking to give RCMP members the right to collective bargaining for the very first time.

Bill C-7 will establish a labour relations regime for RCMP members that complies with the Constitution. This regime will give them the freedom to choose to be represented by a union and to negotiate with the employer so that their labour needs are taken into consideration.

For now, I would like to talk about the second and third amendments proposed by the hon. member for Saanich—Gulf Islands.

As with the labour relations regime that governs police forces across the country, Bill C-7 would exclude some elements from collective bargaining, particularly because of the unique nature of the work RCMP members do. These two proposals would remove conduct, including harassment, from the list of exemptions.

I know that all members share the concerns the hon. member raised about harassment in the RCMP, and this issue is particularly worrisome to the Prime Minister and the Minister of Public Safety and Emergency Preparedness.

I want to share a quote from the Minister of Public Safety's mandate letter, in which he is clearly instructed to “Take action to ensure that the RCMP and all other parts of your portfolio are workplaces free from harassment and sexual violence”.

The minister clearly indicated that he expects allegations of harassment in the RCMP to be handled with comprehensive, transparent investigations; strong discipline; support for victims; and plans to prevent toxic workplace behaviour.

To that end, he asked the Civilian Review and Complaints Commission for the RCMP to undertake a comprehensive review of the force's policies and procedures on workplace harassment, and specifically to examine and evaluate the implementation of the commission's recommendations in its 2013 report.

Furthermore, as the minister emphasized to the committee, this is part of a whole set of initiatives under way to deal with this very troublesome concern, and there is more to come.

Other questions were raised in committee, and there was a lot of discussion about clauses 40 to 42. Under those provisions, the RCMP's occupational health care benefits for workplace injuries or illnesses would have been administered by provincial workers' compensation boards and coverage for RCMP members would have been similar to that of officers working in other police departments. This issue was examined at second reading and then again in committee, where several witnesses appeared to talk about it. In the end, it seemed that everyone agreed to defer consideration of this issue to a later date so that it could be examined in more detail, and these provisions were removed from the bill. This shows how committed our government is to respecting Parliament and the independence of parliamentary committees.

The government still believes that it is not ideal for employers to make the final decision as to whether an injury is work-related.

We will continue to work with the RCMP, its members, and the governments that have contracts with the RCMP in order to implement a long-term solution that will meet members' needs.

Nevertheless, the bill before us is one that would achieve the essential objective of allowing RCMP members to be represented by an employee organization of their choosing. In its decision that found the previous labour-relations regime unconstitutional, the Supreme Court determined that the staff relations representative program, which was imposed upon RCMP members, violated their charter rights because it did not allow members any option for representation, nor did it provide an effective mechanism for dispute resolution. On top of that, the program was not independent of management. Bill C-7 would ensure that RCMP members' charter right to freedom of association is respected.

In addition, the legislation would ensure that any certified RCMP bargaining agent is solely focused on the the representation of RCMP members and would clarify that the Public Service Labour Relations and Employment Board would have to consider the unique role of the RCMP in administering and enforcing the act. The bill also proposes binding arbitration with no right to strike, which would ensure both that the labour rights of RCMP members would be respected and that Canadians could continue to rely on the RCMP to ensure safety and security in communities from coast to coast to coast.

This bill's real purpose is to ensure respect for RCMP members' rights. They were consulted throughout the development of this new labour relations regime, and they are the focus of our attention as we study the bill before us today.

I will conclude by pointing out that, every year, RCMP members respond to well over two million service calls from Canadians while conducting all kinds of complex, long-term federal investigations related to organized crime, financial integrity, corruption, and terrorism.

In addition, as we have seen in northern Alberta, RCMP members are always ready to respond when tragedy strikes. From the onset of the crisis in Fort McMurray, the local RCMP and members of detachments across Alberta have acted in countless ways to support search and evacuation activities, and we will be forever grateful to them for the outstanding work they are doing during this extraordinarily difficult time.

To sum up, the bill before us would protect those who protect us by ensuring a labour relations regime that respects their rights.

Public Service Labour Relations Act May 9th, 2016

Mr. Speaker, I thank my colleague opposite for his thoughtful comments.

I expect or I hope that, as a good Quebecker, he took a special interest as I did over the past two years in the public inquiry into Quebec's construction industry, during which numerous witnesses related horror stories involving dubious practices related to secret ballots.

I would like my colleague to share his views on the protection that type of election affords when, under the proposed alternative, one or the other would be suitable for proper recognition.

Rail Safety Week April 22nd, 2016

Madam Speaker, I want to let members know that Rail Safety Week is from April 25 to May 1 this year. This is an annual campaign organized by Operation Lifesaver to raise awareness and promote safety around trains and rail property.

The Government of Canada supports initiatives to maintain the safety of people and vehicles around rail facilities and supports safety in the transportation of dangerous goods by rail.

Our country has one of the largest rail networks in the world, and we have made it safer for everyone and all communities in Canada. That is what we will continue to do.

Situation in Indigenous Communities April 12th, 2016

Mr. Speaker, in a previous speech, I was surprised to hear from members opposite that the Liberals were only consulting chiefs of communities, as though we were holding back on the resources and tools to achieve results.

Therefore, I invite my hon. colleague to speak more about how we have benefited from communicating with the chiefs of communities.

Situation in Indigenous Communities April 12th, 2016

Mr. Speaker, the only one possibility with tonight's initiative is to all agree on common efforts to support our kids and their families.

On our side, we are involved in the field with projects for which we are waiting some answers to keep on improving those actions. For example, a second crime prevention project called “Strengthening Families Program” was put in place in La Loche in 2014. It is scheduled to run until 2019.

There is some action in the field. I can promise, having been in the field in a previous life, there is no colour, no size and no partisanship. Everyone is working for the same reason.

Allow me to salute and congratulate the efforts of all these officers, namely at Attawapiskat, for the incredible work they are doing and for the incredible workload, hours and stress they are facing in helping our kids everywhere.

Situation in Indigenous Communities April 12th, 2016

Mr. Speaker, my hon. colleague raised a very important point about listening, but I would also add sharing, since sharing plays an important role in indigenous culture. This is exactly the sort of action we have started to take and will continue to take in the coming years. After March 2018, our contribution to the aboriginal policing program will start with consultations focused on listening to and sharing the needs of communities.

Situation in Indigenous Communities April 12th, 2016

Mr. Speaker, thank you for giving me the opportunity to take part in tonight's debate. I want to inform the House that I will be sharing my time with the member for Pontiac.

I first want to thank the member for Timmins—James Bay for moving this motion.

The member's request for an emergency debate includes several references to the word “hope”. It refers to the need to bring a hopeful solution to the desperate situation we see in many northern and indigenous communities. It calls on us to join together to turn the issue into a moment of what he refers to as a “hope-making”. I can assure the member opposite that we share his strong conviction on this issue.

For a long time, the indigenous people across the country have called for change, called for hope. They have sounded the alarm about the rising rates of suicides and suicide attempts, the lack of clean water and proper housing, and the urgent need for action to address violence against indigenous women, children and men.

In just five months, the government and the Prime Minister in particular have taken swift action to begin addressing many of these issues.

Very early on in his mandate, the Prime Minister spoke before the Assembly of First Nations and pledged to renew and restore the relationship between the federal government and indigenous peoples.

Our government is committed to moving forward to implement the recommendations from the Truth and Reconciliation Commission.

The issue of health and safety of indigenous communities was also on the agenda of this past January's meeting between the federal, provincial, and territorial ministers responsible for justice and public safety.

In March, the Minister of Public Safety and Emergency Preparedness addressed the Assembly of First Nations during the Indigenous Public Safety and Policing Forum. The goal was to open a dialogue on the government's work and how to move forward.

The funding allocated in budget 2016 will support education and infrastructure on reserves, which will start to address some of the root causes of poverty and build a brighter future for indigenous peoples.

By improving circumstances in these communities, we can make a difference in reducing the unacceptable and chronic overrepresentation of indigenous people in the justice system. This funding to address root causes is a good start for our work on public safety issues, many of which fall under the purview of Public Safety Canada.

In addition, Public Safety Canada is working closely with Indigenous and Northern Affairs Canada, the Department of Justice, and Status of Women Canada to carry out the important work to be done through the national inquiry into missing and murdered indigenous women and girls.

Of course, a critical element in building strong and healthy communities is ensuring the safety and security of the individuals who live there. This means engaging meaningfully with these communities to make real progress on priority issues such as community safety, supporting youth at risk, and policy.

This becomes all the more urgent in the face of the crisis unfolding in Attawapiskat, where so many young people have attempted to take their lives that the community has declared a state of emergency. Last month we saw a similar action taken by the community of Cross Lake, Manitoba, where an epidemic of suicides prompted leaders to call for urgent emergency help for their community. Also, we cannot forget the tragic events of La Loche, Saskatchewan in January that saw four lives lost and seven others wounded. Sadly, these events are not isolated. There are many communities at risk.

The government is determined to work with the communities that are facing this challenge in order to create lasting solutions that come from the communities, and not from the top down. Public Safety Canada has an important role to play in that regard.

Through the community safety planning initiative, the department helps community members work together to identify risks that can lead to crime and victimization, and builds on local community strength to respond to those risks and to keep people safe. This is a government-supported but community-driven process at work with indigenous communities to identify risks and potential solutions to community safety issues.

The first nations policing program is also key to our work, and lays a strong foundation upon which to build strong, safe communities. The program, which was first introduced in 1991, provides funding to support the provision of professional, dedicated, and responsive policing services to first nations and Inuit communities.

Financial contributions under the program are shared between the federal government and the province or territory, with the federal contribution providing 52% toward eligible costs. To date, there are 186 multi-year agreements in place, which provide funding for 1,299 police officers who are serving 410,000 residents in approximately 400 first nations and Inuit communities.

This program has had a measurable, positive impact on the safety and security of many communities that receive policing services. As members may know, the current agreements expire in two years. Public Safety Canada officials are already exploring ways to ensure that indigenous communities benefit from a renewed and sustainable program that delivers quality policing services beyond March, 2018.

We want to build on the success of the program and the evidence about what works to respond effectively to the policing and public safety needs of indigenous communities. We know that to meet the requirements, we need to consider alternative and innovative approaches in program delivery.

I mentioned earlier that our work must include community input, and our efforts to renew this program will be informed by meaningful engagement with the communities themselves on these important issues.

We are convinced that together with our partners, we will create a strong and renewed program that will provide financial viability and predictability to the first nations policing program.

I would also like to mention the work being done in terms of youth at risk in communities across Canada, including in remote and indigenous communities, under the national crime prevention strategy. When families and youth face bleak futures, the compulsion to tum to crime can be overwhelming.

This is why it is so important to address the root causes of crime and to emphasize prevention. If we want to build a safe society, we must first make our homes and communities safe. This often starts with our children and young people. That is why we need programs for youth at risk.

Through Public Safety Canada's national crime prevention strategy, we can support and nurture critical crime prevention programs. Through this strategy, we can make a difference where it matters, by implementing measures in specific communities that will have a direct impact. The strategy allows us to support programs that reach out to youth through the schools, community centres, and neighbourhood organizations to help steer them away from drugs and gangs. It also helps us to support programs that provide counselling and support to families, and strengthen communities.

Of the 67 active projects, nearly half, 32, focus on indigenous peoples. The majority of these are interventions that are delivered in indigenous communities. I would note that we have a well established project in place in La Loche, and another is in development. These are the types of programs that build community and provide hope for the future for these youth.

In sum, our government is committed to taking bold steps to create a new and stronger relationship with indigenous peoples.

By working together we can give hope to these communities.

Events in Brussels March 22nd, 2016

Mr. Speaker, we are all outraged and deeply saddened by the attacks that took place this morning in Brussels. We offer our sincere condolences to the families and friends of those killed, and we hope for a fast recovery for all those who have been injured.

These attacks once again remind us of the importance of the work that our national security agencies and their international partners are doing to help prevent and combat terrorism and to ensure that those responsible are brought to justice.

We would also like to remind members that Canada needs to be a world leader in the fight against radicalization and that we are working with communities to address this problem.

Canada's solidarity with and friendship for Belgium are unwavering at this difficult time. Terrorism and hatred will never have a place in our free and open societies.

The message we would like to send to the people of Belgium comes from their national anthem, La Brabançonne, which says: We swear with one cry—You shall live!

Federal Public Sector Labour Relations Act March 22nd, 2016

Mr. Speaker, I would like to thank my colleague for her speech and for sharing her interest in officers' compensation.

The exercise concerns BillC-7, and we have a very limited amount of time as we had to ask for an extension because the deadline had passed. I would like to give my colleague the opportunity to explain in a little more detail the basis on which the court is interpreting the process that the RCMP will use to decide on certification and whether there will be a secret ballot. I hope she will excuse my legal and technical ignorance. The court's simply requested that by May 16 we have a provision that will allow the RCMP to proceed.
